General Terms and Conditions (GTC)

§1 Scope of Application

These General Terms and Conditions (GTC) apply to all purchase contracts concluded via the webshop under the domain "thecatch.ch".

Customer support is provided via email and additionally via WhatsApp.

§2 Subject Matter of the Contract

The products displayed in the webshop do not constitute a legally binding offer but rather a non-binding invitation to the customer to order products.

§3 Conclusion of Contract

By clicking the "Order with obligation to pay" button, the customer submits a binding offer to conclude a purchase contract.

The contract is concluded as soon as the customer receives an order confirmation by email. Automatically generated order confirmations do not yet constitute acceptance but merely confirm receipt of the order.

The provider reserves the right to refuse orders without stating reasons.

The customer can correct input errors at any time before submitting the order.

§4 Prices and Payment

All prices are in Swiss Francs (CHF) including statutory value-added tax (if applicable) and excluding shipping costs.

Shipping costs are shown separately during the ordering process.

The following payment methods are available:

  • PayPal
  • Credit card (e.g., Visa, Mastercard, American Express)
  • Advance payment (bank transfer)
  • Klarna

The provider reserves the right to exclude individual payment methods.

§5 Right of Withdrawal / Right of Return

According to Swiss law, there is generally no statutory right of withdrawal.

The provider voluntarily grants a right of return according to the conditions published on the website.

The right of return specifically excludes:

  • opened or used cosmetic products
  • sealed products whose seal has been removed
  • products that cannot be resold for hygienic reasons

The customer is obliged to inspect the goods before use.

§6 Delivery and Shipping

Delivery takes place within 3–8 working days after receipt of payment, unless otherwise specified.

Delivery delays due to force majeure or unforeseeable events do not entitle to claims for damages.

§7 Warranty (Liability for Defects)

The statutory warranty rights according to the Swiss Code of Obligations (OR) apply.

The customer must inspect the goods immediately upon receipt and report any defects without delay. If this is not done, the goods are deemed to have been approved.

§8 Liability

The provider is only liable for damages caused intentionally or by gross negligence.

Liability for slight negligence is excluded, as far as legally permissible.

Liability for the following remains reserved:

  • Injury to life, limb, or health
  • mandatory statutory liability provisions (e.g., product liability)

 

§9 Retention of Title

The goods remain the property of the provider until full payment has been made.

§10 Data Protection and Communication (incl. WhatsApp)

The processing of personal data is carried out in accordance with the Swiss Data Protection Act (DSG).

Communication via WhatsApp

The customer also has the option to contact customer support via WhatsApp.

It should be noted:

  • WhatsApp is a service of Meta Platforms Inc.
  • When using, personal data (e.g., phone number, message content, metadata) may be transmitted to servers abroad (especially USA)
  • The provider has no influence on this data processing by WhatsApp

By contacting via WhatsApp, the customer expressly agrees to this data transfer.

It is recommended not to transmit sensitive data via WhatsApp.

§11 Place of Jurisdiction and Applicable Law

Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction is – as far as legally permissible – the provider's registered office in Herrliberg, Switzerland.

For consumers, the mandatory places of jurisdiction according to Swiss law apply.
